
उत्तर प्रदेश में हुक्का बार और रेस्टोरेंट में हुक्का सर्व करने को लेकर इलाहाबाद हाईकोर्ट ने बड़ा फैसला सुनाया है। इलाहाबाद हाईकोर्ट की लखनऊ बेंच ने स्पष्ट किया है कि रेस्टोरेंट, कैफे, होटल और अन्य सार्वजनिक स्थानों पर बने Designated Smoking Area (निर्धारित धूम्रपान क्षेत्र) में भी ग्राहकों को हुक्का सर्व नहीं किया जा सकता। अदालत ने हुक्का बार के संचालन से संबंधित मुख्य याचिका समेत जुड़ी हुई 80 याचिकाओं को खारिज कर दिया।
Allahabad High Court ने क्या कहा?
न्यायमूर्ति शेखर बी. सराफ और न्यायमूर्ति ए.के. चौधरी की खंडपीठ ने कहा कि Designated Smoking Area सार्वजनिक स्थानों पर धूम्रपान प्रतिबंध के तहत एक सीमित अपवाद है। इसका मतलब यह नहीं है कि रेस्टोरेंट या कैफे वहां ग्राहकों को कोई smoking-related service उपलब्ध करा सकता है।
कोर्ट के अनुसार, Cigarettes and Other Tobacco Products Act, 2003 (COTPA) और Prohibition of Smoking in Public Places Rules, 2008 के प्रावधान हुक्का सर्विस पर लागू होते हैं। 2017 में नियम में किए गए बदलाव के बाद Designated Smoking Area में “any service” यानी किसी भी प्रकार की सेवा की अनुमति नहीं है।
Smoking Area में हुक्का क्यों नहीं दिया जा सकता?
कोर्ट ने स्पष्ट किया कि किसी रेस्टोरेंट में अलग से Smoking Area बना होने से वहां हुक्का सर्व करने की अनुमति नहीं मिल जाती।
हुक्का सर्विस में केवल ग्राहक को तैयार हुक्का देना ही शामिल नहीं है। हुक्का तैयार करना, उसमें तंबाकू भरना, कोयला लगाना, ग्राहक तक हुक्का पहुंचाना, कोयला बदलना, राख हटाना या हुक्के को बनाए रखना जैसी गतिविधियां भी सेवा का हिस्सा मानी जा सकती हैं।
क्या ग्राहक खुद हुक्का चलाए तो अनुमति होगी?
याचिकाकर्ताओं की ओर से यह दलील दी गई थी कि अगर रेस्टोरेंट केवल तैयार हुक्का ग्राहक को उपलब्ध कराए और ग्राहक खुद उसका इस्तेमाल करे, तो इसे self-service या rental माना जाना चाहिए।
हाईकोर्ट ने इस तर्क को स्वीकार नहीं किया। अदालत ने माना कि हुक्का तैयार करके ग्राहक को उपलब्ध कराने और उसके उपयोग के लिए आवश्यक व्यवस्था करने में सेवा का तत्व मौजूद रहता है। इसलिए केवल ग्राहक के खुद हुक्का चलाने से उस गतिविधि की कानूनी प्रकृति नहीं बदलती।
Food Safety या Municipal License से नहीं चलेगा Hookah Bar
हाईकोर्ट ने लाइसेंस को लेकर भी स्थिति स्पष्ट की है। अदालत के अनुसार Food Safety Department और Municipal Corporation के पास हुक्का बार संचालित करने के लिए अलग लाइसेंस जारी करने का अधिकार नहीं है।
इसका मतलब यह है कि केवल किसी रेस्टोरेंट के पास वैध food establishment या अन्य स्थानीय लाइसेंस होने से उसे हुक्का बार चलाने की अनुमति नहीं मिल जाती।
पुलिस कर सकती है कार्रवाई
कोर्ट ने यह भी स्पष्ट किया कि COTPA के तहत पुलिस अधिकारियों को कानून के उल्लंघन की स्थिति में कार्रवाई करने की शक्ति प्राप्त है। इसमें परिस्थितियों के अनुसार तलाशी, सामान जब्त करना और कानूनी कार्रवाई जैसी शक्तियां शामिल हो सकती हैं।
हाईकोर्ट ने अपने फैसले की एक प्रति उत्तर प्रदेश के मुख्य सचिव और पुलिस महानिदेशक (DGP) को आवश्यक अनुपालन के लिए भेजने का निर्देश भी दिया।
Clean Air को लेकर हाईकोर्ट की टिप्पणी
फैसले में अदालत ने सार्वजनिक स्थानों पर गैर-धूम्रपान करने वाले लोगों के स्वच्छ हवा में सांस लेने के अधिकार पर भी जोर दिया।
अदालत ने Article 21 के तहत clean air के अधिकार और किसी व्यावसायिक प्रतिष्ठान के व्यापारिक हित के बीच अंतर पर टिप्पणी की। कोर्ट के अनुसार, किसी सार्वजनिक स्थान पर गैर-धूम्रपान करने वाले व्यक्ति के स्वच्छ हवा में सांस लेने के अधिकार को केवल व्यावसायिक गतिविधि के आधार पर सीमित नहीं किया जा सकता।
UP में Hookah Bar को लेकर अब क्या स्थिति है?
इस फैसले के बाद रेस्टोरेंट, कैफे और अन्य सार्वजनिक स्थानों पर Designated Smoking Area बनाकर हुक्का सर्व करने की दलील स्वीकार नहीं की जा सकती। अदालत ने हुक्का बार संचालन और रेस्टोरेंट द्वारा हुक्का सेवा को संबंधित कानूनी प्रावधानों के विपरीत माना है।
हालांकि, इस फैसले का मुख्य कानूनी प्रश्न यह था कि क्या कोई रेस्टोरेंट Designated Smoking Area के अंदर ग्राहकों को हुक्का एक सेवा के रूप में उपलब्ध करा सकता है। हाईकोर्ट ने इसका जवाब स्पष्ट रूप से नकारात्मक दिया है।
UP Hookah Ban: Allahabad High Court Bars Hookah Service in Smoking Areas, Major Decision
The Allahabad High Court has delivered a significant ruling on hookah bars and hookah service in restaurants and cafes in Uttar Pradesh. The Lucknow Bench of the Allahabad High Court has made it clear that customers cannot be served hookah even inside a Designated Smoking Area (DSA) created within a restaurant, cafe or other public place.
The court dismissed 80 petitions filed in connection with hookah service and operations, making it clear that a designated smoking area cannot be treated as a space where restaurants are permitted to provide hookah-related services.
What Did the Allahabad High Court Say About Hookah?
The bench comprising Justice Shekhar B. Saraf and Justice A.K. Choudhary considered the provisions of the Cigarettes and Other Tobacco Products Act, 2003 (COTPA) and the Prohibition of Smoking in Public Places Rules, 2008.
The court held that a Designated Smoking Area is a limited exception under the rules relating to smoking in public places. It does not mean that a restaurant or cafe can provide customers with hookah services inside such an area.
The court also considered the effect of the 2017 amendment, under which services are not permitted inside a Designated Smoking Area.
Can Customers Use the Hookah Themselves?
One of the arguments raised before the court was that a restaurant could provide a prepared hookah to a customer and allow the customer to operate it independently.
The petitioners also argued that providing a hookah could be treated as self-service or rental, rather than a service provided by the restaurant.
The High Court did not accept this argument. The court made it clear that simply describing the activity as self-service or rental does not change its legal character when the establishment is involved in preparing or providing the hookah for use.
Food Safety or Municipal Licence Does Not Authorise a Hookah Bar
The High Court also clarified the issue of licensing.
According to the ruling, the Food Safety Department and Municipal Corporation do not have the authority to issue a separate licence for operating a hookah bar.
Therefore, having a restaurant, food establishment or other local licence does not automatically give an establishment permission to operate a hookah bar or provide hookah service.
The court examined the issue in the context of the provisions applicable to smoking in public places and tobacco-related activities.
Police Can Take Legal Action
The court also dealt with the enforcement powers available under COTPA.
Where there is a violation of the applicable law, authorities can take action in accordance with the statutory provisions. The powers discussed in the case include measures such as search, seizure and confiscation, along with other legal proceedings wherever applicable.
The court also directed that a copy of the judgment be sent to the Chief Secretary of Uttar Pradesh and the Director General of Police (DGP) for necessary compliance.
High Court’s Observation on the Right to Clean Air
The judgment also dealt with the rights of people who do not smoke.
The court emphasised the importance of the right of non-smokers to breathe clean air in public places. The issue was considered in the context of Article 21 of the Constitution, which has been interpreted by courts in relation to the right to life and a clean environment.
The court considered that the right of non-smokers to clean air cannot simply be restricted because a commercial establishment wants to provide a particular smoking-related service.
What Does the UP Hookah Ban Decision Mean for Restaurants and Cafes?
The ruling makes the legal position regarding hookah service in Designated Smoking Areas clear.
Restaurants, cafes and other establishments cannot rely only on the existence of a separate smoking area to claim that hookah service is permitted there.
The judgment is particularly relevant to establishments that were using Designated Smoking Areas as a basis for providing hookah to customers.
The court has rejected the petitions challenging action against such hookah-related activities.
